Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Prestige Excavation & Drainage of CT (“Company,” “we,” “our,” or “us”) regarding your use of our website and services.

By accessing our website, requesting estimates, scheduling services, or entering into a service contract with us, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.

About Our Company

Prestige Excavation & Drainage of CT is a licensed and insured excavation and drainage company serving Connecticut’s Naugatuck Valley region since 2015. We provide residential excavation, drainage solutions, land clearing, forestry mulching, grading, stump grinding, tree removal, retaining wall construction, landscape construction, rock removal, earth moving, and driveway excavation services.

Scope of Services

We provide the following services to residential property owners in Connecticut:

  1. Excavation Services: Foundation excavation, basement excavation, site preparation, trenching, and general excavation
  2. Drainage Solutions: French drain installation, catch basin installation, yard drainage, foundation drainage, and drainage system design
  3. Land Clearing: Tree removal, brush clearing, stump grinding, site clearing, and debris removal
  4. Forestry Mulching: Vegetation grinding, invasive species control, trail creation, and land improvement
  5. Grading: Rough grading, finish grading, yard leveling, drainage grading, and site preparation
  6. Stump Grinding: Stump removal to below-grade level
  7. Tree Removal: Safe tree removal of all sizes, hazardous tree removal, and storm damage response
  8. Retaining Wall Construction: Block walls, stone walls, segmental retaining walls, and drainage integration
  9. Landscape Construction: Hardscaping, patio installation, walkway construction, and site preparation
  10. Rock Removal & Earth Moving: Ledge removal, boulder removal, rock breaking, and bulk earth moving
  11. Driveway & Roadway Excavation: Driveway excavation, base preparation, culvert installation, and paving prep

Service Limitations

We provide services to residential property owners. We generally do not provide:

  • Commercial or industrial excavation (unless specifically agreed)
  • Services outside our defined service area without a special arrangement
  • Work that violates local, state, or federal regulations
  • Services on properties where legal access or ownership is disputed

Estimates and Proposals

Free Estimates

We provide free, no-obligation estimates for all services. Estimates include:

  • Description of work to be performed
  • Materials and equipment required
  • Timeline expectations
  • Total estimated cost

Estimate Validity

Estimates are valid for 30 days from the date issued unless otherwise specified. Prices may change after this period due to material cost fluctuations, labor rate changes, or scope modifications.

Estimate Accuracy

Estimates are based on visible conditions at the time of site assessment. We make reasonable efforts to provide accurate estimates, but actual costs may vary if:

  • Hidden or unexpected conditions are discovered (rock, utilities, poor soil, etc.)
  • Project scope changes at your request
  • Permit requirements differ from expected
  • Material costs increase significantly
  • Weather or other factors affect the project

We will notify you of any significant cost changes before proceeding with additional work.

Estimates Are Not Guarantees

Estimates represent our best professional judgment based on available information. They are not guaranteed fixed prices unless explicitly stated as such in a written contract. Certain factors (particularly subsurface conditions like rock) cannot be determined until excavation begins.

Contracts and Agreements

Written Contracts

All projects exceeding $500 will be documented in a written contract specifying:

  • Detailed scope of work
  • Materials and specifications
  • Project timeline and schedule
  • Payment terms and total cost
  • Change order procedures
  • Warranty information
  • Insurance and liability provisions

Contract Modifications

Any changes to the contract scope, timeline, or cost must be documented in a written change order signed by both parties before work proceeds.

Right to Refuse Service

We reserve the right to refuse service if:

  • Property access or ownership is unclear
  • Necessary permits cannot be obtained
  • Site conditions make work unsafe or impractical
  • Payment terms cannot be agreed upon
  • We believe the project violates regulations

Pricing and Payment Terms

Pricing Structure

Our pricing is based on:

  • Labor time and expertise required
  • Equipment needed for the project
  • Materials and supplies
  • Disposal or hauling costs
  • Site conditions and accessibility
  • Project complexity and scope

Payment Terms

Small Projects (Under $2,000): Payment due upon completion

Medium Projects ($2,000 – $10,000):

  • Deposit: 25-30% to schedule and secure materials
  • Balance: Due upon satisfactory completion

Large Projects (Over $10,000):

  • Deposit: 25-30% to begin
  • Progress payments: As agreed for project milestones
  • Final payment: Upon completion

Accepted Payment Methods

We accept:

  • Personal or business checks
  • Cash
  • Bank transfers or wire payments
  • Major credit cards (processing fees may apply)

Late Payment

Payments not received within 15 days of the due date will incur a late fee of 1.5% per month (18% annual percentage rate) or the maximum rate permitted by Connecticut law, whichever is less.

Liens and Collection

Connecticut law allows contractors to place mechanics’ liens on properties for unpaid services. If legal action is necessary to collect payment, you agree to pay our reasonable attorney fees and collection costs in addition to the outstanding balance.

Permits and Regulatory Compliance

Client Responsibility for Permits

Unless otherwise specified in the contract, obtaining required building permits, zoning approvals, and other regulatory permissions is your responsibility as the property owner. We will:

  • Advise you on permit requirements based on our experience
  • Provide technical documentation needed for permit applications
  • Coordinate with inspectors as required
  • Perform work according to permitted plans

Compliance with Laws

We conduct all work in compliance with:

  • Connecticut state building codes and regulations
  • Local municipal ordinances and requirements
  • Environmental regulations and wetland protections
  • OSHA safety standards
  • Connecticut utility location laws (811 requirements)

Permit Delays

Project timelines may be extended due to permit processing delays. We are not liable for delays caused by municipal or regulatory approval processes.

Project Timeline and Scheduling

Timeline Estimates

Project timelines provided are estimates based on normal working conditions. Actual completion may be affected by:

  • Weather conditions (rain, snow, extreme temperatures)
  • Permit delays
  • Material delivery delays
  • Discovery of unexpected site conditions (rock, utilities, contamination)
  • Client-requested changes
  • Access restrictions

Schedule Changes

We will make reasonable efforts to maintain project schedules. However, we reserve the right to adjust schedules due to:

  • Weather conditions unsuitable for excavation or construction
  • Equipment breakdowns or maintenance needs
  • Crew scheduling requirements
  • Emergency service calls taking priority
  • Safety concerns

We will communicate schedule changes promptly and work to minimize delays.

Client Responsibilities

To maintain project schedules, clients must:

  • Provide clear property access for equipment
  • Remove or relocate vehicles, outdoor furniture, and other obstacles
  • Secure pets during work hours
  • Ensure utilities have been marked by calling 811
  • Provide timely approvals for change orders
  • Make progress payments as agreed

Site Access and Conditions

Access Requirements

You grant us reasonable access to your property during agreed work hours to perform services. This includes:

  • Access for equipment and vehicles
  • Space for material staging and storage
  • Right to cross your property to reach work areas

Property Protection

We will make reasonable efforts to protect your property during our work, including:

  • Marking areas to be protected
  • Using ground protection mats when appropriate
  • Avoiding unnecessary damage to landscaping
  • Working carefully around structures and features

However, some temporary disruption is inherent to excavation and site work. We are not responsible for:

  • Damage to unmarked underground utilities
  • Damage to unidentified structures or features
  • Minor disturbance to lawn areas where equipment operates
  • Settling that may occur after excavation and backfilling

Underground Utilities

Critical Requirement: Connecticut law requires calling 811 (Call Before You Dig) before excavation. You must call 811 at least 48 hours before scheduled work to have utilities marked. We will call 811 as well, but you, as the property owner share responsibility for this critical safety step.

We are not responsible for damage to:

  • Unmarked or improperly marked utilities
  • Private utilities (irrigation systems, landscape lighting, etc.) that are not marked by 811
  • Utilities marked incorrectly by utility companies

Hazardous Materials

If hazardous materials (contaminated soil, asbestos, etc.) are discovered during excavation, work will stop immediately. Hazardous material remediation is not included in our standard services and requires specialized contractors. Additional costs will apply.

Changes and Additional Work

Change Orders

Any changes to the original contract scope must be documented in a written change order specifying:

  • Description of changed or additional work
  • Cost adjustment (addition or credit)
  • Timeline impact
  • Revised payment terms if applicable

Change orders must be signed by both parties before work proceeds.

Unexpected Conditions

If we encounter unexpected conditions during excavation (rock, poor soil, utilities, etc.), we will:

  • Stop work and assess the situation
  • Notify you promptly
  • Provide cost and timeline estimates for addressing the condition
  • Await your approval before proceeding

You may choose to:

  • Approve additional work to address the condition
  • Modify the project to avoid the condition if possible
  • Halt the project (subject to payment for work completed)

Warranties and Guarantees

Workmanship Warranty

We warrant that all work will be performed in a professional and workmanlike manner consistent with industry standards. Specific warranty terms are outlined in individual project contracts.

Typical warranty coverage:

  • Excavation Work: We warrant proper grades and drainage function
  • Drainage Systems: We warrant proper installation and function for the specified period
  • Retaining Walls: We warrant structural integrity when properly maintained
  • Grading: We warrant proper slopes and drainage patterns

Warranty Limitations

Warranties do not cover:

  • Damage from improper maintenance or alterations by others
  • Damage from extreme weather events or acts of God
  • Settling that occurs naturally over time
  • Damage from client misuse or neglect
  • Issues arising from work performed by others
  • Normal wear and weathering of materials

Material Warranties

Materials are typically covered by manufacturers’ warranties, which we will pass through to you. We do not extend the manufacturers’ warranty terms.

Warranty Claims

To make a warranty claim:

  1. Contact us promptly when you discover an issue
  2. Allow us a reasonable time to inspect the issue
  3. Allow us the opportunity to remedy the problem
  4. Provide reasonable access to the site for repairs

Limitation of Liability

General Limitations

To the fullest extent permitted by Connecticut law, our total liability for any claim arising from our services is limited to the amount you paid for the specific service giving rise to the claim.

We are not liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits or business interruption
  • Damages exceeding the contract value
  • Damages from conditions we could not reasonably discover
  • Delays caused by circumstances beyond our control

Property Damage

Our liability insurance covers accidental property damage during our operations, subject to policy limits and exclusions. We are not responsible for:

  • Pre-existing damage or defects
  • Damage from client’s failure to disclose known hazards
  • Damage to unmarked utilities or structures
  • Consequential damages resulting from covered damage

Indemnification

You agree to indemnify and hold us harmless from claims, damages, or expenses arising from:

  • Your failure to obtain the required permits
  • Your failure to disclose known site hazards
  • Your interference with our work
  • Claims by third parties based on your actions
  • Your use of our work product in ways not intended

Emergency Services

Emergency Response

We provide 24/7 emergency response for urgent situations, including:

  • Basement flooding from drainage failures
  • Storm damage requiring immediate excavation response
  • Collapsed walls or slopes threatening structures
  • Utility emergencies requiring excavation access

Emergency Service Terms

Emergency services may be subject to:

  • Premium pricing for after-hours response
  • Limited diagnostic time before providing cost estimates
  • Immediate payment terms
  • Temporary stabilization pending full repairs

Emergency Service Limitations

Emergency response times vary based on:

  • Weather and road conditions
  • Distance to your location
  • Severity and number of concurrent emergencies
  • Equipment and crew availability

We will make reasonable efforts to respond promptly, but we cannot guarantee specific response times.

Insurance and Licensing

Our Insurance Coverage

Prestige Excavation & Drainage carries:

  • Commercial General Liability Insurance
  • Workers’ Compensation Insurance
  • Equipment and Vehicle Insurance

We will provide certificates of insurance upon request.

Your Insurance

We recommend you:

  • Notify your homeowners’ insurance carrier of planned excavation work
  • Verify your coverage for excavation-related risks
  • Maintain adequate property insurance

Licensing

We maintain all required Connecticut business licenses and registrations. We use licensed subcontractors for specialized work requiring specific licenses (blasting, engineering, etc.).

Safety and Site Conduct

Safety Standards

We follow OSHA safety standards and Connecticut safety regulations. Our safety practices include:

  • Proper equipment operation and maintenance
  • Personal protective equipment for all workers
  • Safe excavation and trenching practices
  • Hazard identification and mitigation
  • Regular safety training

Site Safety

During our work:

  • Work areas may be hazardous
  • Keep children and pets away from work zones
  • Do not enter excavations or approach equipment
  • Follow any safety instructions from our crew
  • Do not operate or touch our equipment

Client Safety Responsibilities

You are responsible for:

  • Keeping family members and guests away from active work areas
  • Securing pets during work hours
  • Not interfering with our work or equipment
  • Following any safety barriers or warnings we establish

Intellectual Property

Project Documentation

Project plans, designs, and specifications remain our property unless otherwise agreed. You may use them for the specific project contracted but may not:

  • Share them with competitors
  • Use them for other projects without permission
  • Claim them as your own work

Photos and Marketing

We may photograph completed projects for our portfolio, website, and marketing materials. If you prefer we not use photos of your property, please notify us in writing.

Dispute Resolution

Good Faith Resolution

We are committed to resolving any disputes amicably. If you have concerns:

  3. Allow us a reasonable opportunity to address your concerns

Mediation

If we cannot resolve a dispute through direct discussion, both parties agree to attempt resolution through mediation before pursuing legal action. Mediation costs will be shared equally.

Governing Law and Venue

These Terms are governed by the laws of the State of Connecticut without regard to conflict of law provisions.

Jurisdiction and Venue: Any legal action, suit, or proceeding arising out of or relating to these Terms or our services must be brought exclusively in the state courts of New Haven County, Connecticut, or in the United States District Court for the District of Connecticut. Both parties consent to the personal jurisdiction and venue of these courts.

Our business is located in Oxford, Connecticut, which is within New Haven County.

Limitation of Actions

Any claim or action arising from our services must be brought within two (2) years of when the claim arose or when you reasonably should have discovered the issue.

Termination

Termination by Client

You may terminate a contract before work begins by providing written notice. If work has begun, you may terminate by:

  • Providing written notice
  • Paying for all work completed to date
  • Paying for materials ordered or delivered
  • Paying reasonable demobilization costs

Termination by Company

We may terminate a contract if:

  • You fail to make payments when due
  • You fail to provide reasonable site access
  • You interfere with our work or crew safety
  • Site conditions make work impossible or unsafe
  • You breach the material terms of the contract

Effect of Termination

Upon termination:

  • You must pay for all work completed
  • You must pay for materials delivered or ordered
  • We will remove our equipment and materials
  • Any deposits paid are non-refundable, but will be credited against work performed

Miscellaneous Provisions

Entire Agreement

These Terms, together with any written contract for specific services, constitute the entire agreement between you and Prestige Excavation & Drainage. They supersede all prior verbal or written communications.

Modifications

We may update these Terms at any time by posting revised Terms on our website. Material changes will be communicated to active clients. Continued use of our services after changes constitutes acceptance.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Waiver

Our failure to enforce any provision does not waive our right to enforce it later or to enforce other provisions.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations to a successor business entity.

Force Majeure

We are not liable for delays or failures to perform due to circumstances beyond our reasonable control, including:

  • Natural disasters or severe weather
  • Government restrictions or regulations
  • Labor disputes or shortages
  • Material shortages or supplier failures
  • Utility failures or access restrictions
  • Pandemic or public health emergencies

Survival

Provisions regarding payment, liability limitation, warranties, and dispute resolution survive termination of the service relationship.
